Warranty
March Manufacturing’s pumps are warranted only to the original purchaser thereof to be free of defects in workmanship and materials under normal use for a period of twelve (12) months from the date of manufacture. This warranty will be extended to twelve (12) months from the date of original installation if the warranty card is completely filled in and returned to March Manufacturing or registered online at www.marchpump.com/warranty-registration.
This warranty covers only pumps properly installed and maintained in accordance with March Manufacturing’s instructions. Any March Manufacturing pump which the purchaser considers to be defective must be returned to the source where it was purchased. If the pump is found by March Manufacturing to be defective in workmanship or materials under normal use within the warranty period, March Manufacturing, at its sole option, will either replace or repair the pump. This warranty does not cover any costs associated with the installation, removal, or transportation cost of the pump. If the pump was damaged in transit, the purchaser should file a claim with the carrier.
The purchaser is responsible to select the materials used in the pump’s construction, so that they are compatible with the liquids that travel through the pump. The purchaser may consult March Manufacturing or a distributor to seek a recommendation for the materials used in the construction of the pump, so as to obtain the optimum available chemical compatibility. However, neither March Manufacturing nor the distributor shall be liable for product damage or failure, personal injuries, or any other damages, whether special, incidental, punitive or consequential, arising out of a reaction, interaction or any chemical effect that occurs between the materials used in the pump’s construction and the liquids that travel through the pump.
Before using the pump, the purchaser or installer should determine the suitability of the pump for its intended use. Purchaser assumes all risk and liability whatsoever in connection with such use or installation. Except as otherwise specifically provided herein, in no event will March Manufacturing be liable for claims or damages, whether in contract, in tort (including negligence and strict liability) or otherwise.
MARCH MANUFACTURING ‘S SOLE LIABILITY AND THE SOLE REMEDY UNDER THIS CONTRACT SHALL BE FOR ANY BREACH OF WARRANTY AS SET FORTH ABOVE. THE WARRANTY SET FORTH ABOVE IS IN LIEU OF ALL OTHER WARRANTIES OF MARCH MANUFACTURING, WHETHER WRITTEN, ORAL OR IMPLIED, AND MARCH MANUFACTURING HEREBY DISCLAIMS ANY OTHER REPRESENTATION OR WARRANTY, WHETHER EXPRESSED, IMPLIED OR STATUTORY, AS TO ANY MATTER WHATSOEVER, INCLUDING WITHOUT LIMITATION, THE DESIGN OF THE PUMP, ITS MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR PURPOSE. IN NO EVENT SHALL MARCH MANUFACTURING BE LIABLE FOR LIQUIDATED, SPECIAL, INCIDENTAL, PUNITIVE OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO LOSS OF PRODUCTION OR DELAYS IN CONSTRUCTION.
